Car Accident Insurance

I got in an accident and wasnt at fault, the lady who hit me didnt have insurance... and my medical bills are about 3800! but I kind of need a bit more than that! i bought a car, had to pay gas when i was without one.. what do you think?

I think that unless you sue for more, you won't get more.

this is re: a very minor accident. our car "bumped" into the other car after they slammed on their breaks. No damage at all to our car. The license plate and screws are "bent" on the other car. Other person uncooperative and after we gave our insurance info to them, refused to give info to us. Police on scene did not file report, told us to just deal with it on our own. My worry is, can they file a claim? wouldn't it be just our word against theirs? advice would be helpful thanks.

Yes, they can file a claim and claim you did damage to their car and they now have whip lash. You should have told the police they were refusing to give you their information and it could have been dealt with at the time.

All you can do now is file with your insurance so they will be ready when the other person tries to scam you for bunches of money. If the police were there, even if they didn't do a formal report there should be something on the log about it. As I said, report it to your insurance with all the information you have, and hope they will do the right thing. Hopefully you did get the license number and make and model of the car you hit.

When signing up for car insurance, it asks on the application whether the driver has been in a car accident in the past 5 years. What is considered a car accident? Let's say I hit someone, but both parties decided not to report it. As far as the insurance company is concerned, is that considered a car accident for their purposes or no?

In such a case, what would one answer? Yes or No?

i have always had car insurance. but it was cancelled recently. i was looking for car insurance but couldnt avoid driving because of work, and school. i got an insurance policy right after the accident. i just want to know if i show my proof of insurance in court if they will still suspend my licensce. if it helps i live in cali.

Just because you have insurance now means nothing. You got into a acident WO insurance, and that will be the factors they look at. saying you could not avoid driving because of work, and school is just a cop out. You can get car insurance the same day you apply for it. Yes your licence has a good chance of being suspended, and I hope it does.

I also live in California and its people like you who mess things up for us who follow the driving laws.

I was in a car accident with no insurance and they claim I owed over $6,000. I end up talking it down to $3,000 even. I wanted to know did I over paid or was that a fair amount. The person had whiplash and received treatment and the car was damage at the rear end.

Make sure you pay by check or money order so you have proof of payment.

You should have asked them for an estimate to fix their car and any medical bills. $3,000 sounds fair but you have asked for an estimate for their car repair bill from a few different shops first.

And, did the other guy get paid from his car insurance too? They are not allowed to collect twice. Just for your info.
